ПРОБЛЕМИ ВИЗНАЧЕННЯ ПРАВОВОГО ЗВ’ЯЗКУ ВПРОВАДЖЕННЯ ТА РЕАЛІЗАЦІЇ ПРОТИЕПІДЕМІЧНИХ ЗАХОДІВ ІЗ ЗАХИСТОМ ПРАВ ЛЮДИНИ І ГРОМАДЯНИНА

Анотація
Мета. Метою статті є встановлення актуальних проблем визначення правового зв’язку впровадження та реалізації протиепідемічних заходів із захистом прав людини і громадянина й обґрунтування шляхів удосконалення його нормативно-правової реґламентації. Методи. У статті використано системно-структурний, структурнологічний, логіко-семантичний, формально-юридичний, порівняльно-правовий, індукції та дедукції, аналізу й синтезу й інші методи наукового пізнання. Результати. У першому після вступу розділі статті визначено сучасний стан нормативно-правової реґламентації прав людини і громадянина у сфері впровадження та реалізації протиепідемічних заходів. У другому розділі статті розглянуто, які права та свободи захищаються за допомогою впровадження та реалізації протиепідемічних заходів. У третьому – які легітимні цілі (публічні інтереси) має їх упровадження відповідно до положень Конвенції про захист прав людини й основоположних свобод. У четвертому – обмеженнями яких прав може супроводжуватись упровадження протиепідемічних заходів. У п’ятому – чи закріплено на рівні закону можливість і допустимість обмежень прав людини в разі впровадження та реалізації протиепідемічних заходів. Висновки. У висновках підкреслено, що принцип верховенства права передбачає вищий пріоритет прав і свобод людини, тому будь-які обмеження прав і свобод та пов’язані з ними в такому разі протиепідемічні заходи мають бути законні, зрозумілі та належним чином обґрунтовані. У зв’язку із цим жодні прогалини, неточності, колізії в законодавстві, яке регулює впровадження та реалізацію протиепідемічних заходів, не можуть бути допустимими. Наголошено на тому, що розглянуті у статті проблеми нормативно-правового регулювання мають бути виправлені шляхом внесення відповідних змін і доповнень до чинного законодавства. Зокрема запропоновано: 1) уточнити мету вжиття протиепідемічних заходів, додавши до неї захист прав і свобод громадян, чітко вказати, на забезпечення яких саме прав вони спрямовані; 2) внести зміни до Закону України «Основи законодавства України про охорону здоров’я» та виправити помилку, за якої самостійні основоположні права віднесено до змісту рівноцінного їм права на охорону здоров’я; 3) чітко закріпити у протиепідемічному законодавстві вичерпний перелік прав і свобод громадян, які можуть бути обмежені під час впровадження та реалізації протиепідемічних заходів, на яких умовах, строк, з якою метою та в яких межах.
