The Forms of Peaceful Assemblies and their Characteristics through the Article 39 of the Ukrainian Constitution

Abstract
An attempt to analyze all the possible forms of peaceful assemblies is made in the article through the provisions of the article 30 of the Ukrainian Constitution, domestic and European case law as well as best practice of legal science. The author emphasizes and defines peculiarities of the following forms of peaceful assemblies: meetings, parades, musical festivals, street celebrations and street theatre performance, concerts, small protests, infrastructure elements, information rooms, political assemblies, blocking, acquisition by seizure of the objects, smart mobs and flash mobs, costume performances, strikes of employees, special public assemblies, open air assemblies and indoor assemblies.
While analyzing the mentioned forms of assemblies the author forms conditions when these events are protected by the Article 39 of the Ukrainian Constitution. Conditions (circumstances) which exclude the possibility to refer public events to the category of peaceful assemblies are emphasized.
