Lawmaking activities of the European Commission of the EU

Abstract

The article deals with some aspects of legislative activities of the European Commission of the EU.

The author observes that the Commission is competent to create the following regulations: 1) directive. Directive is a legislative act of the European Union, which requires all Member States to make or refrain from performing certain actions in order to achieve a specific result, as a rule, not regulating the means of achieving that outcome, while leaving, the freedom of choice of forms and methods of action for their implementation that is inherently conditional condition; 2) regulations (regulation). Terms unlike directive is an act of direct application and does not require the adoption of national legislation.

Emphasized that the redundancy claims, whereby major institutions and Member States may apply to the Court of Justice requiring the Commission to abolish its act, is an important factor in the high quality of its legislative activities.

It is concluded that the main executive body of the European Union is the European Commission, which has broad (especially after the adoption and entry into force of the Lisbon Treaty) in rule-making powers , namely: 1) the exclusive legislative initiative (all major regulations adopted Council or the Council together with Parliament, considered on the basis of projects made by the Commission); 2) develop opinions on legal acts and programs of the Council and the European Parliament (compliance and enforcement of the comments in the findings shall be binding subject to the adoption of the act); 3) direct rule-making (preparation and adoption of regulations and directives - that create the foundation of secondary EU law).
