Legal Regulation of Information Security in Ukraine. Theoretical and practical prob
Abstract
This article focuses on the following problem: modern information technologies create not only new opportunities to increase the efficiency of public administration. They also lead to new security threats. A lot of these are related to the information sphere, including the manipulation of public opinion for aggravation of social conflicts and other challenges aimed at the violation of the sovereignty of the state in the information sphere. For the implementation of effective systems of protection of people, society and state in the information sphere it is proposed a conceptual definition of information security as a comprehensive legal category.
The issue of information security is relevant to the theory and practice in many areas of law. However, the nature and content of both categories in the scientific literature reveals ambiguous and complex research are neglected by the developers of specific laws and law projects.
The article also pays attention to the scientific community to seek consensus in the formulation of the concept of «information security» as a doctrinal category, including the doctrine of information law. In terms of administrative law and process information security should be considered as a socio-technological legal phenomenon in the formation of the general provisions relating to quality guarantees, security and defense of the information rights in correlation with governmental, civil, political, economic and cultural interests in the country, public moral values.
Effective implementation of strategic national priorities, the basic principles and objectives of public security policy requires switching to a different paradigm of organizational improvement and, therefore, legal components of the public administration area of information society: codification of information laws paradigm. It is proposed, in substance, to consider the information security in the trinity: as the field of public relations, as a sub sector of Information Law, as an academic discipline.
