Attempt of political and legal evaluation of annexation of the Autonomous Republic of Crimea by the Russian Federation
Abstract
The article is devoted to the attempt of political and legal evaluation of the annexation of the Autonomous Republic of Crimea by the Russian Federation. The author scrutinizes the positions of Ukraine, the Russian Federation and international community concerning the events connected with the change of status and state affiliation of the Autonomous Republic of Crimea. The study identifies the main arguments to substantiate the illegality of actions that violated the national unity and territorial integrity of Ukraine by forcible annexation of the part of its territory to the other state.
Political and legal assessment of the events connected with the annexation of the territory of Ukraine, in particular the Autonomous Republic of Crimea in March 2014, is relevant due to the necessity to clarify the illegality of actions of an aggressor to public in terms of the Ukrainian national legislation and international law, in order to prevent further negligence of the terms of constitutional and legal provisions of Ukrainian law and basic principles of international law.
The aim of the article is to analyze international, Ukrainian and Russian legislation in order to substantiate invalidity of actions and unlawful annexation of Ukrainian territory carried out by the armed forces and institutions of political power of the Russian Federation. Confrontation between the two principles of international law – the principle of inviolability of frontiers and the principle of the right of peoples to self-determination and their application in the context of the issue of this article are also investigated. It is suggested that the establishment of international practice of ostensible realization of the principle of peoples to self-determination (as was the case with the ARC) is a precondition for the repetition of the precedent in future, that can completely negate a fundamental principle of international law - the principle of the inviolability of frontiers. It is also pointed out that even with the recognition of the universality of the right of peoples to self- determination it can only be brought to practice as a result of comprehensive dialogue and within the law. For example, consideration of alternatives of solution to the issue such as extended autonomy of the Autonomous Republic of Crimea within Ukraine and engagement of the central government in Kiev in the dialogue.
