Realization of Personal Non-property Right of a Child to a Proper Parental Education and Its Protection

Abstract

At the present stage of Ukrainian society’s development the problem of realizing individual rights, including personal non-property rights acquires special significance and places new demands on the quality of Ukrainian laws, legal institutions, their relevance, and effectiveness, degree of impact on human qualities and progress of society. Indeed, it is a value of legal system and its perfection is largely due to a person’s place and role in it, a person’s rights and how they are realized and what are the guarantees of these rights.

The objective of this article is to determine the content of personal non-property right of a child to appropriate parental education, identifying features of realization and research of forms and methods of protection.

Thus, the problems of human rights in general, and personal non-property rights in particular, have long worried scientists in the area of civil law, that’s why domestic and foreign authors devoted their research to their civil and legal regulation at different stages of development, formation, realization and protection.

However, despite the relatively large number of scientific papers, the realities of present time require reconsideration of procedures for realizing children rights in Ukraine under the UN Convention on Children Rights and legislation in force. There is no any principle of keeping the best interests of a child, which is the base of the Convention.

The problem of children’s’ rights is one of the most important problems of modern society, so gradually such a legal category as «a child» obtained regulatory consolidation on a global level, and later in the national legislation of Ukraine by the way of conducting series of research and collaboration of different countries of the world. The specification of the rights of such specific and most vulnerable social groups as children and the desire to create an effective mechanism of protection has led scholars and public officials to the thought about the need to single out children rights into a separate category. As a result current legislation of Ukraine prefers the priority of children rights, their guaranteeing and realization, which in turn causes increased theoretical and practical interest in the study of the legal nature of personal nonproperty rights of a child and promotes reflection of the fundamental features and characteristics that reflect their inner content and structure. It should be noted that the state of regulatory guaranteeing of realizing personal nonproperty rights of a child to education and protection is at enough high level in the national legislation that meets the highest international standards for the protection of children rights. However, consideration of certain issues of law enforcement activity only proves the fact that it is not enough to create a regulatory mechanism. The main task should be guaranteeing its operation in practice with a strict compliance of all international standards of children rights.
