The Criminal Treasury Code of Republic of Poland: the content of the sections of the introductory provisions, the exclusion of punishment of the guilty person, treasury crimes, treasury misconducts and treasury explaining the concepts used

Abstract

The article presents a translation of the General part of the first head of the Criminal Treasury Code of Republic of Poland. The structure of General part of this Code and his individual sections as «introductory provisions», «exclusion of punishment of the guilty person», «treasury crime», «treasury offenses», «clarification of the concepts used in the law» are determined.

The article provides translation of structural «components» of the General part of the first cheapter of the Criminal Treasury Code of Republic of Poland, concepts «act», «treasury crime», «treasury misconduct», «forbidden act», «active behavior», «subject, instituted criminal proceedings against for a treasury crime», «subject, instituted criminal proceedings against for treasury misconduct», «dispatch responsibility», «combined punishment», «threat of punishment», «publicly harmful act», «behavior», «guilty responsibility», «legal entity», «organizational unit, that does not have status of legal entity and legal capacity», «intentional feasance», «unintentional feasance», «legal consequence commission of treasury crime and treasury misconduct» and concept principle code, rules awarding punishment, criminal sanction and safety sanction for the feasance treasury crime and treasury misconduct, exception from punishment of a guilty person.

The concepts of responsibility and diminished responsibility are translated. The concepts of application of measures of criminal-law influence for the feasance of treasury crimes, treasury misconducts, dispatch responsibility for treasury crimes and the questions of setting of the combined punishment are translated. Author translated the concepts of principle of humanizing while determination of punishments in the General part of the first cheapter of the Criminal Treasury Code of Republic of Poland.
