Subject of administrative information offenses: concept and features
Abstract
In this article concept, features and types of subjects of information administrative offenses are investigated, their administrative delictual characteristic is given, place of a subject of administrative information offenses in structure of body of tort is represented, special features of particular categories of subjects that committed offenses in information sphere are determined, some changes to administrative delictual legislation of Ukraine are suggested. Author also proves the necessity of referring legal persons – participants of information relations to general categories of subjects of information administrative offenses, if they are not conducted specific types of information activities.
Separate scientific development in this article is given to the problem of determination an individual entrepreneur as a special subject of information administrative offenses, cases when these participants of information relations are referred to special subjects by law are provided. In this scientific work separate groups of features under which a participant of information relations is recognized a special subject of information administrative offenses by administrative delictual legislation are distinguished.
According to the results of the carried research the author states that today most of the administrative information offenses are committed by special subjects: government officials and civil servants of bodies of state authorities and local government, market participants; legal persons that conduct specific types of information activities for which it is mandatory to obtain a special permit (license) and such legislation tendency has grounds to expand.
