Theoretical foundations of administrative services in the European Union and Ukraine
Abstract
The article investigates theoretical foundations of rendering administrative services in the European Union and the features of the theory of public services. In the article we summarize positive experience of Western European countries and its usage in the Ukrainian legislation. Special attention is devoted to research of the basic directions of European administrative legal doctrine, generalization of the problems of definitions and the legal nature of the services provided in the public sector, study features of the theory of public services.
The main features of administrative services are: public services are the monopoly of the state or local authorities; services provided in connection with the established responsibilitiesor powers, and not on the basis of commercial agreements; decision of providing of individual services belonging to the discretionary powers; legally possible to appeal against an administrative act issued on the results of the providing of public services. European researchers analyze the implementation of the tasks and functions of public administration in the service of citizens (positive sphere of public administration).
Author has concluded that the following problems require further development: theory of administrative acts conforms to the European experience requirements for acceptance, modification, cancellation and possibilities of appeal of individual administrative acts; further investigation of the role of discretionary decision making process of administrative services; increasing of the powers of local government in the area of providing of administrative services.
