Law of Peaceful Protests in the System of Administrative Law of Germany

Abstract

The article is devoted to the analysis of the essence and content of law of peaceful protests in Germany through finding out the place of the mentioned legal formation in the system of administrative law. In the beginning of the article the author makes a point about conducting of legal comparative researches and makes a conclusion about an obligatory necessity to take into consideration European legal practice and doctrine in the sphere which is considered. In the author’s view, necessity of this decision is caused by the fact that Ukrainian administrative courts limit the right to peaceful protests by private parties in many cases without any reason what in turn hampers democratic processes in Ukraine. Lack of knowledge on modern European standards in the sphere of law of peaceful protests by the representatives of judicial power is mentioned as one of the causes of such situation.

In order to achieve the mentioned goal the author analyzes briefly the inner structure of German administrative law. It is stressed that this body of law consists of General Administrative Law and Special Administrative Law which in turn regulates separate spheres of activity of administrative agencies, forms a big cornerstone which is divid­ed into separate branches such as municipal law, police law, construction law, traffic law, industrial and economic law, social law, school law, high school law and so on.

Special attention is paid to finding out of peculiarities and goal of German police law which is one of the main elements of Special Administrative Law. It was possible to conclude on the basis of conducted research that law of peaceful protests is the ele­ment of the system of police law. The reasons and necessity to place the law of peace­ful protests in the system of police law are explained.

The system of law of peaceful protests is considered. This law consists of the follow­ing elements: sources of law of peaceful protests; the main definitions of the law of peaceful protests; legal status of the participants of peaceful protests; institute of in­forming about the planned peaceful protest; authorities of police in the sphere of or­ganization and conducting of peaceful protests; peaceful protests in closed premises; institute of liability for breaking procedure of organization and conducting of peace­ful protest established by legislation. When the author analyzes the content of the in­stitutes of German law of peaceful protests he refers to court practice, gives examples and makes a conclusion that German courts contributed to the concretization of the content of many provisions on law of peaceful protests.

The conclusion is made in the end of the article that it is necessary to transform the system of administrative law of Ukraine which is directed on the following differenti­ation of its norms. To author’s view, only in such a way it will be possible to achieve a necessary level of specialization and training of subjects who enforce law especially in the sphere of law of peaceful protests.
