Constitutional and legal mechanism to ensure the equality of rights and freedoms of man and citizen in Ukraine

Abstract

To date, an urgent need to develop a proper legal system for the protection of fundamental rights and freedoms of man and citizen in general, and a mechanism to ensure the principle of equality of rights and freedoms of man and citizen in particular.

A feature of this mechanism is that the subject of its regulation is not only the principle of equality, but the totality of the rights and freedoms of man and citizen (political, personal, economic, social, cultural, environmental, etc.). Delineated system also includes an array of related groups of objects of regulation.

It is advisable to consider the constitutional and legal mechanism to ensure the principle of equality of rights and freedoms of man and citizen in terms of its security, that is, as a mechanism to ensure the implementation of the provisions declared legal acts embodying the principle of equality of rights and freedoms of man and citizen in Ukraine.

We believe that under this mechanism should be understood an integral system of legal forms, activities and resources, cooperation which is aimed at the realization of equality of rights and freedoms of man and citizen, protection against encroachments on the rights and freedoms and to prevent violations of the principle of equality of rights and freedoms of man and citizen, or updates or complained of violated rights and freedoms in terms of equality in Ukraine. It has its own structure, which is characterized by the unity of the elements in a determined relationship.

Thus it can be stated that the mechanism for ensuring the rights and freedoms of man and citizen is broader and covers the «realization of the rights and freedoms of man and citizen», «protection of the rights and freedoms of man and citizen», «protection of the rights and freedoms of man and citizen».

In our opinion, the constitutional and legal framework to ensure the principle of equality of rights and freedoms of man and citizen in Ukraine can be viewed through the prism of guarantees, because they are directly set legal regulations fixing the position of underlying mechanism for the principle. On the basis of analysis and generalization of rules of constitutional law in Ukraine, we can conclude that at present there is no single legal act that would secure all the list of the guarantees of equality of rights and freedoms of man and citizen.

Establishment of the declared performance of the principle of equality of rights and freedoms of man and citizen requires a more thorough approach, namely the reform of the current system in order to eliminate gaps and align with the best international standards and requirements of international instruments agreed to binding by the Ukraine (among them, in Specifically, as a basis - the European Convention on Human Rights), changes in the course of their operation.

Thus, the constitutional and legal mechanism to ensure the principle of equality of rights and freedoms of man and citizen in Ukraine - is defined by the Constitution and laws of Ukraine, in their entirety, a set of legal guarantees regulatory and institutional nature, which provide legal impact on public relations for the lawful implementation, conservation and protection of equal rights in Ukraine.
